If a picture contains the actors laughing together while not in the middle of acting and without the crew visible, can it be considered at "behind the scenes" category? I read the thread about the differences, but there it's mentioned that "behind the scenes" contains crew visible. However it's not a publicity still either as they are clearly not acting in that particular scene.

I'm sorry for being so late in responding and I hope I can answer your question to your satisfaction. A behind the scenes photo can have crew and/or cameras/equipment visible and those are easy enough to determine that they're BTS photos. The ones without crew or equipment can be a little trickier to tell if they're BTS or not and because the actors in the photo are smiling or laughing that does not mean they're BTS, they could be promos or publicity stills.
As you said, if the actors are clearly not in a scene, then it's either a promo or a BTS photo. I hope that clears it up for you. :)
